1 - Data ControllerOLYSEUM, S.A., a company listed in the registry of the canton of Geneva under number CHE-466.576.451, with its address at Rue Saint-Léger 8, c/o MN Trust SA, 1205, Geneva, Switzerland, as the owner of the social platform OLYSEUM (hereinafter, “OLYSEUM”), hereby informs you that it shall process the personal data collected via this website and the Olyseum mobile application (hereinafter, the “app”).
The term “Users” refers to any natural or legal persons who make use of any of the services provided by OLYSEUM on the website or app as a Fan, Star, Community, Advertiser or any other kind of Member.
2 - Data collectedNo personal data are automatically registered merely by visiting the website. However, there is certain information that is collected and recorded on OLYSEUM’s servers by means of cookies (such as the type of browser or operating system and the IP address) in order to improve Users’ browsing and to manage the website and the app. The use and purpose of the cookies are set out in the Cookies Policy.
In the event that an Internet user decides to register as a Member of the website, he/she shall be asked to provide the information indicated on the registration form and a password to protect his/her account from unauthorised access.
In addition, in the event that a user of the Internet or the app decides to register as a Star, Community or Advertiser on the website, or any other category of Member, he/she shall be provided with a username and password for access to the website and the app.
In any event, Users shall be held liable for the truthfulness of the data supplied when providing the required information. Being a User of the website or app thus means that the quality of the information provided must be guaranteed vis-à-vis both OLYSEUM and third parties, in other words, the data and information provided by Users must be real, true and updated. In any case, the provision of false or outdated data is forbidden and Users must always identify themselves with their real name and surnames or the correct company name, supplying accurate and current data.
To this effect, Users shall be held solely liable for any direct and/or indirect damages caused to a third party or OLYSEUM by means of the use of the personal data of another natural or legal person or their own personal data when they are false, erroneous, outdated, inadequate or irrelevant.
3 - Purpose of the processingOLYSEUM shall use Users’ personal information in order to provide any of the services on this website and the app and to improve Users’ experience in the process of subscribing to the Service.
Users’ data shall thus be processed for the following purposes:
- To manage Users’ registrations on the website and the app;
- To manage Users’ interaction with the website, the app and the rewards system;
- To post the comments that Members make in the place enabled on the website or the app;
- To manage the sending of promotional correspondence to Users with regard to OLYSEUM’s commercial and advertising information, in the event that they have expressly requested it;
OLYSEUM may use the personal data to develop methods to manage, improve and expand the services provided via the website. Specifically, the data collected may be used to manage, improve and optimise Users’ interaction and, in general, to improve the service provided to Users.
OLYSEUM shall only assign Users’ personal data for the aforementioned purposes and process them confidentially. In the event that the information is used for a different purpose, OLYSEUM shall request the prior consent of the User who owns the personal information.
4 - Commercial correspondenceIn compliance with the Loi fédérale contre la concurrence déloyale (LCD), RS 241, Users are hereby informed that they shall NOT be sent commercial correspondence that they have not authorised or requested in the section enabled for such purposes by email, SMS, WhatsApp or any other means of instant messaging.
5 - Legitimation of the processingWe are committed to the responsible management of Users’ personal data in compliance with the Loi fédérale sur la protection des données (LPD), RS 235.1 and the Ordinance related to the Loi fédérale relative à la protection des données (OLPD), RS 235.11, as well as the General Data Protection Regulation (GDPR) of the European Union.
The legal basis for the processing of Members’ data is the express consent granted for the fulfilment of the purposes outlined above by means of the sending of the form.
Similarly, the basis that legitimises the processing of Star, Community and Advertiser data is the contractual relationship entered into with OLYSEUM.
6 - Recipients of assignments and transfersOLYSEUM is the sole recipient of the data collected from Users, except in the cases which are legally appropriate.
Users’ personal data may be processed by third-party service suppliers to OLYSEUM for the sending of commercial, promotional and advertising correspondence. These suppliers shall process the information provided and respect its confidentiality at all times, in accordance with the previously authorised purposes.
7 - Data conservationOLYSEUM shall only store Users’ personal data for as long as they are necessary for the purpose for which they are collected and in accordance with the legal basis legitimising their processing, provided the Member has not withdrawn his/her consent or the Star, Community or Advertiser has not terminated the binding contract with OLYSEUM.
Similarly, Users may exercise their rights of deletion and cancellation and the limitation of the processing.
If any of the above-mentioned cases occur, OLYSEUM may duly block the data, without making any use of them, for as long as they are necessary to exercise its right of defence in the event of potential claims or in the event that legal, judicial or contractual liabilities arise that must be addressed, for which their recovery may be necessary.
8 - Rights of interested partiesUsers may exercise their right of access to the personal data and the information related to them, as well as request the rectification of any inaccurate data or, as appropriate, request their deletion when the data are no longer necessary for the purposes for which they are collected. They may also request the limitation of the processing, the portability of the data and the opposition to their processing for reasons related to their individual situation.
Similarly, Members have the right to withdraw the consent granted at any time, without this affecting the lawfulness of the processing performed before the withdrawal of the consent.
Users may exercise the above-mentioned rights, under the terms and conditions envisaged in the current legislation, by writing to OLYSEUM, S.A. at Rue Saint-Léger 8, c/o MN Trust SA, 1205, Geneva, Switzerland or firstname.lastname@example.org, indicating the right they wish to exercise and enclosing/attaching a scanned copy of their ID card or an equivalent document valid in law to prove their identity.
In the event that no satisfactory reply is received and they wish to submit a claim or obtain further information on their rights, they can contact the Federal Data Protection and Information Commissioner (FDPIC) or the data protection agency in their country.
9 - Security measuresOLYSEUM has taken the appropriate technical and organisational measures to ensure an adequate level of security for the personal data it processes and it has implemented other means and additional technical measures within its scope to prevent their loss or alteration and unauthorised processing or access.
